Release of Liability, Waiver of Claims, Assumption of Risk and Indemnity Agreement (\u201cWaiver Agreement\u201d) MICHYLA VIG, hereinafter referred to as \u201cKALON Pilates.\u201d WAIVER AGREEMENT, to be accepted by all Adults, participating in online Pilates. <\/span><\/p><p><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">IN CONSIDERATION of my participation in online Pilates classes organized by KALON Pilates, I HEREBY IRREVOCABLY AND UNCONDITIONALLY WAIVE AND RELEASE, indemnify, hold harmless and forever discharge KALON Pilates, her members, guests, employees, volunteers, officers, directors, affiliates, successors and assigns (such parties collectively referred to as the \u201cReleased Parties\u201d), from any and all claims, demands, debts, contracts, expenses, causes of action, lawsuits, damages and liabilities, of any kind and nature, whether known or unknown, in law or equity, that I have or may have, arising from or in any way related to my voluntary participation in online Pilates, even if arising from the negligence of the released parties; provided, however, that this waiver of liability does not apply to acts of intentional misconduct. I confirm that I am over eighteen (18) years old, and I understand and agree that:<\/span><\/p><p><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">a) The risk of injury from activities involving online Pilates, could be significant, including the potential for bodily injury or harm, paralysis, disability, fatality and damage to personal property, and while particular skills, equipment, and personal discipline may reduce these risks, the risk of injury does exist;<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">b) I knowingly and freely assume all such risks, both known and unknown, even if they arise from the negligence of the released parties or others, and I assume full responsibility for my participation;<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">c) I agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual, significant hazard during KALON Pilates; and<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">d) I certify that I have no physical or mental condition that would prevent me from safely participating in online Pilates classes.<\/span><\/p><p><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">I have read, understand and fully agree to the terms of this waiver and release. I understand and confirm that by purchasing\/joining KALON Pilates\u2019 monthly membership I have given up substantial future legal rights, including the right to sue, and my purchase is proof of my intention to execute a complete and unconditional waiver and release of all liability to the full extent of the law.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">I accept this waiver and release freely and voluntarily without any inducement and under no duress or threat of duress. You may cancel at any time.
